The demonstration near Bil'in (B-il-lin), Friday, 6 May 2005

 

Bil'in is a village of some 1600 inhabitants, whose main source of income has

traditionally been agriculture. It is located some 4 km east of the "green
line" (the pre 1967 border of Israel), east of the Israeli City of Modiin, that
was illegally expanded into the occupied territory of the West Bank as a
cluster of settlements consisting of Modiin Ilit, Kyriat Sefer, Hashmonaim,
Matityahu, Shilat, Lapid, Menora (the whole "megila").  Bil'in is a mere 10 km
west of the Palestinian City of Ramallah.

Bil'in possessed about 4000 dunam [an acre is a bit more than 4 dunams]
before the building of the Apartheid Wall and the illegal settlements, of which
1700 dunams remain.

The people of Bil'in with the support of hundreds of Israelis as well as a
dedicated group of peace activists from abroad, have been conducting a series
of non-violent protests against the construction of the Apartheid Wall and the
massive confiscation of their lands.

The demonstration that took place on Friday, 6 May 2005, was no exception.

As soon as the demonstrators walked out of the village into its own surrounding
lands they were challenged by a group of Israeli soldiers, armored to their
teeth, whose officer declared this non-violent march an illegal demonstration
and ordered all the participants to return into the village.
This announcement was immediately followed by a heavy "rain" of "tear-gas"
grenades that made the participants disperse away from the dirt road that they
were marching on into the fields. The dispersing crowd was followed by more
tear gas grenades and soon afterwards several people were very aggressively
handcuffed and detained. The 8 or so detainees were left, with their hands
cuffed behind their backs, to sit and wait for several hours before they were
driven to the police station in the illegal settlement of Giv'at Zeev for
"interrogation". The two women detained were treated "more kindly": their hands
were cuffed in front which made it a bit easier for them to sit down on the
ground and eventually in the police van. Don't ask me how they attended to such
needs as drinking or relieving themselves with their hands cuffed. I didn't
inquire. Since all the detainees were "of the right race" (the only non-Israeli
was a German) they were realised after their "interrogation". The two
Palestinians who had been detained some 9 days ago are still in prison, so far
without charges. In other places such practice might be referred to as
Apartheid. Not here. We (Israelis) are morally infallible!

One of the detainees was Rabbi Arik Asherman, head of Rabbis for Human Rights. I
know Rabbi Asherman fairly well. He is the only person I have ever met who is
possibly one of the Lamed Vav (the 36 righteous people thanks to whom the world
keeps existing, according to the Jewish tradition). If the Israeli
army/border-police can detain HIM, they should be considered as Ovdei Avoda
Zara Befarhesiya.

I did not reach the site where the "real action" took place, so my reporting and
pictures are rather incomplete. Sorry about that. I will try to be more
adventurous next time around.

In any case, I, and two other Israelis, were hit by what may be stones or
perhaps some variant of a "rubber bullet". One of the victims actually
identified the person who targeted her, who was disguised as a Palestinian but
when she tried to talk to him he become very aggressive in a manner that
clearly indicated that he was yet another undercover Israeli soldier. Whether
this conduct is honorable, or even legal under the terms of the Geneva
Convention (that Israel signed but tends to ignore) is a matter for higher
experts than myself to consider. I was afterwards shown a sample rubber bullet,
which is a cylinder of roughly equal diameter and height (about 15mm)
consisting of black rubber, imbedding a steel(?) ball whose diameter is roughly
5mm, that could be seen through a tear in the rubber coating. There may be
other varieties as well  ("lo alman yisrael";
or, more colloquially "haroash hayehudi mamzee lanu patentim". My Israeli
readers will perhaps find these expressions funny, but they are not worth
translating). The sharpshooter who aimed at the elbows did a great job in two
cases that I am aware of, so he needs no further practice the next time around;
Mr. Chief-of-Staff, please give him a couple of months leave. They say that
Hague is a nice city.

CONCLUSION:  A Palestinian non-violent protest will not be tolerated by the
Israeli Army.

הרב אריק אשרמן מנכ"ל
שומרי משפט רבנים למען זכויות האדם

להלן מחשבותי מההפגנה ביום ששי 6.5.2005.

"אין לכם רשיון להפגין". שמענו את האמירה הזאת מספר פעמים במשך המעצר שלנו ביום
שישי. עיקר הסיפור בבלעין אינו השימוש המופרז בכוח (שהיה, ועל כך אספר) או
שעשרה אנשים, ואני ביניהם, נעצרו בהפגנה, ובהפגנה שלפני ובהפגנה שלפני זאת,
וכולי. בראש וראשונה הסיפור הוא סיפורם של בני אדם שהם קורבנות תוואי הגדר,
היוצר קונפליקט לא הכרחי בין זכותנו לביטחון ובין זכותם של הפלשתינאים
לאדמותיהם. גם האלימות של כוחות הביטחון היא תוצאה של שכנוע עמוק שמה שהם
עושים הכרחי לביטחון המדינה. אבל על משמעותה של הגדר בבלעין, אינני יכול
להסביר יותר מאשר הטור של גדעון לוי מיום ו'. למי שלא קרא, הוא מצורף.

אז על מה נשאר לכתוב? נדמה לי שהאמירה "אין לכם רשיון להפגין" נוגעת בבעיה
שבלב כל קונפליקט בין קבוצה שולטת ובין קבוצה נשלטת, וכבר אפשר ללמוד אותה
מפרשת השבוע של השבוע שעבר, פרשת קדושים. יש אומרים שפרשת קדושים היא שחזור
עשרת הדברות במלים אחרות. בין היתר, היא כוללת את המצוות "ואהבת לרעך כמוך",
"לא תעמוד על דם רעך", ו-"וכי יגור אתך גר בארצכם לא תונו אותו. כאזרח מכם יהיה
לכם הגר הגר אתכם ואהבת לו כמוך כי גרים הייתם בארץ מצרים" יש משהו לא נכון
ואף מקומם בהשוואת הגר לפלשתינאי, אבל "הגר, היתום והאלמנה" מסמלים בתורה את
החלשים בחברה. המאפיין של החלש הוא שלא שומעים אותו. אין לו אפילו זכות להפגין.
במאמר מומלץ על הגר בהגותו של אבן עזרא, מתוך "עיונים במשפט העברי ובהלכה",
פרופ' יעקב בלידשטיין מציין שאבן עזרא מדגיש את הקלות שבה אפילו המערכת המשפטית
יכולה לנצל את חוסר האונים של הגר, האלמנה והיתום, "כי אין להם עוזר והנה גם
הוא בסתר והזכיר הגר גם היתום והאלמנה כי אם יטה הדיין משפט אחרים יערערו עליו
ויפרסמוהו והגר והיתום והאלמנה אין להם כח" (אבן עזרא לדברים כ"ז:י"ט)

בדיוני בג"ץ על תוואי הגדר ניבחן כחברה. האם יישמנו את האזהרות של אבן עזרא
לדיינים? האם הבג"ץ ימשיך להפגין את האומץ שהפגין בשנה שעברה כאשר פסק נגד
תוואי הגדר, ויפסוק שגם התוואי החדש אינו עומד בקריטריונים שקבע, או האם יחליט
שאינו יכול לעמוד נגד צה"ל והממשלה? אתמול לראשונה נדרשה המדינה לספק תגובה
משפטית לחוות הדעת של בית הדין הבין-לאומי בהאג. האם יהיה לבג"ץ האומץ למצות את
הדיון עד תום וליישם בפסיקתו אלמנטים של פסק-הדין שניתן בהאג, במידה ויימצאו
ראויים? גם עצם העובדה שפלשתינאים נאלצים לעתור לבית דין ישראלי, ושכמעט ולא
נוכחו כלל במרתון הדיונים בשנה שעברה, מוכיחה את האמת בדבריו של אבן עזרא. אבל
גם בתנאים האלה, כאשר אין לפלשתינאים אפשרות להביא את זעקתם ישירות אל עם ישראל
כמו שעושים מתנחלי גוש קטיף, עלינו לשאת תפילה שדיינינו יעמדו במבחן.

משך כל השעות הארוכות שחבריי ואני היו עצורים, כמה מאתנו ניסו לדובב את השוטרים
והחיילים. לרוב לא הצלחנו, אם כי היו שני חיילים שמתן ויותם הצליחו להוציא מהם
את המשפט "בכמה דברים אתם צודקים", עד שנשלחו לעוד מרדף אחר ילדים זורקי-אבנים.
רק בסוף, אחרי שהדברים נרגעו וישבנו בתחנת המשטרה, שוטר שסירב קודם לכן באופן
שיטתי לשוחח התחיל להקשיב כאשר הסברתי לו שספירת העומר היא בין היתר ספירת
הימים בין יציאת מצריים לבין קבלת עול מצוות בהר סיני. הזכרתי לו שלא סתם
שוחררנו ממצרים, אלא שיצאנו משם כדי לקבל אותו עול. כמוכן הזכרתי לו את דבריו
של הרב שמשון רפאל הירש, ששורש הרע במצרים אשר עלינו ללמוד ממנו ולא לחזור
עליו, היה היחס הפוגע באחר. "כל קיפוח של זכויות האדם יפתח שער לשרירות
ולהתעללות באדם – הוא שורש כל תועבת מצרים” (הרב הירש לשמות כ"ב:כ, “גר לא תונה
ולא תלחצנו כי-גרים הייתם בארץ מצרים”). דיברנו על מדוע אהבת הגר ואי-ניצולו
היא המצווה שחוזרת על עצמה הכי הרבה פעמים בתורה – 36 פעמים. שוחחנו גם על
האמירה של הרב אברהם יהושע השל שבדמוקרטיה יש קומץ של אשמים, אבל כולנו אחראים.
אחרי יום שלם שבו השוטר סירב לשוחח הרגשתי שסוף סוף הוא מקשיב. אין לי אשליה
שהוא מתכוון מחר לסרב לאבטח את העבודות על הגדר, אבל אני תקווה שבאיזשהו מקום
פנימי, לקחי פרשת קדושים חדרו אליו. ואז אולי נהיה קצת קרובים יותר ל-"קדושים
תהיו כי קדוש אנוכי ה' אלוהיכם" (ויקרא י"ט: ב).


עוד מספר מחשבות:
1. בתהלוכה שיצאה מבלעין נשמעה הקריאה "לא, לא לגדר; אין מה לדבר". אזי אמר אחד
מהתושבים "אבל רגע, אנחנו רוצים לדבר". אז השתנתה הקריאה: "לא, לא לגדר; כן, כן
לדבר". אז תושב אחר שאל "אבל על מה יש לדבר עם הצבא?" שוב, הסיסמא הוחלפה ל"לא,
לא לגדר, על הגדר אין מה לדבר." נדמה לי שמתוך חילופי הדעות הללו, עלה הרצון
העז של העם הפלסטיני להגיע להסכם אתנו דרך משא ומתן, והקושי לעשות זאת כאשר
האקדח מכוון לרקה, ואפילו זעקה מרה של מאבק לא-אלים היא בלתי-אפשרית.
2. יש בידי את התמונה שבה צילמתי את הקצין ששלף את האלה והרביץ לפחות לארבעה
מחבריי. עד הרגע שהתחיל להכות, לא נזרקה אבן אחת; ההפגנה התקיימה לאחר סוף
העבודה היומית על התוואי. לא נשקפה שום סכנה לאדם או לרכוש. כנראה פעל בכוחות
הביטחון יצר כוחני שלא היה מוכן לאפשר לפלשתינאים להפגין בשקט ולחזור הביתה
בשלום. כשהחיילים רצו לקראתנו מרחוק, הקצין התחיל בלי אזהרה להכות אנשים
ברגליים ולהגיד להם שהם עצורים. לי הוא לא הרביץ; שכבתי על האדמה, והוא אמר שאם
לא אקום בכוחות עצמי הוא ייאלץ להכאיב לי.כשאמרתי שזה נתון לבחירתו, הוא הרים
ידיים ואמר "אני לא יכול". שמחתי שלא אספוג מכות, ושוב אדגיש כי אינני רואה את
האלימות של כוחות הביטחון כעיקר הסיפור. יחד עם זאת, תהיתי איך הכיפה, ומעט
שערות השיבה בזקן שלי העניקו לי חסינות, כשלא הייתה לו בעיה להכות צעירים שגם
הם לא עשו דבר. מדוע לא היה מסוגל לראות שאותו צלם אלוהים שוכן בתוך כל אחד
מאתנו?

נמשיך לעקוב אחרי דיוני בג"ץ. עלינו לעשות הכל כדי שזעקת הגר, היתום והאלמנה
תישמע ותזכה למענה בחברה שלנו.
